The terms that govern your use of the Cellavie platform.
Effective date: April 2026
By accessing or using the Cellavie platform (cellavie.co.za), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the platform.
We may update these Terms from time to time. Continued use of Cellavie after changes are published constitutes acceptance of the revised Terms. We will notify you of material changes by email or through the platform.
To access certain features of Cellavie, you must create an account. Account registration and authentication is provided through Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration. You must be at least 18 years old to create an account, in line with the legal drinking age in South Africa.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
Cellavie offers a Wine Passport subscription service that includes features such as check-in tracking, digital stamps, missions, and exclusive offers. Subscription plans and pricing are displayed on our pricing page.
Subscriptions are billed through Stripe on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
You may cancel your subscription at any time through your account dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. We do not offer partial refunds for unused portions of a billing period.
Cellavie offers a free tier with limited check-ins and features. Free users may upgrade to a paid plan at any time.
Cellavie aggregates wine farm information from publicly available sources, including farm websites, tourism directories, and mapping services. While we make every effort to ensure accuracy, we cannot guarantee that all farm details (opening hours, services, contact information, pricing) are current or complete.
Wine farm owners and authorised representatives may claim their listing on Cellavie. Once verified, claimed farms can update their own information, add photos, manage events, and access visitor analytics. Cellavie reserves the right to verify ownership before granting claim access.
Cellavie is not responsible for the quality, safety, or availability of services offered by listed wine farms. Interactions between users and farms are between those parties directly.
You may submit content to Cellavie, including reviews, tasting notes, ratings, and photographs ("User Content"). By submitting User Content, you grant Cellavie a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content in connection with the platform.
You retain ownership of your User Content. You represent and warrant that you have the right to submit it and that it does not infringe any third-party rights.
Cellavie reserves the right to review, edit, or remove any User Content that violates these Terms, is misleading, defamatory, obscene, or otherwise objectionable. We may moderate content proactively or in response to reports from other users or farm owners.
The Cellavie name, logo, brand identity, website design, software, and all original content are the intellectual property of Cellavie (Pty) Ltd and are protected by South African and international intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works from any part of the Cellavie platform without our prior written consent. Farm names, logos, and images displayed on the platform remain the property of their respective owners.
When using Cellavie, you agree not to:
• Use the platform for any unlawful purpose.
• Submit false, misleading, or fraudulent reviews or check-ins.
• Scrape, crawl, or use automated tools to extract data from the platform without written permission.
• Attempt to gain unauthorised access to other user accounts or platform systems.
• Interfere with or disrupt the platform or its infrastructure.
• Impersonate another person or entity.
Cellavie is provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, Cellavie disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Cellavie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, revenue, or business opportunity.
Our total liability for any claim arising from these Terms or your use of Cellavie shall not exceed the amount you paid to us in subscription fees during the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Cellavie, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your User Content, or your breach of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of Cellavie shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division of the High Court of South Africa.
